Marty Frenkel and David Hart lead the Financial Services & Real Property Litigation Group and share their perspectives.

MARTIN (“Marty”) S. FRENKEL, shareholder, is an experienced business litigator and executive committee member and co-chair of the Financial Services and Real Property Litigation group.

A graduate of the University of Michigan in 1991 with high distinction and Wayne State University Law School in 1994, Marty previously worked for the Michigan Department of Attorney General.

Since 1997, he has been with Maddin Hauser. Marty specializes in real estate and financial services risk management, litigation, and regulatory compliance matters. He focuses on matters involving mortgage, banking, construction, real estate development, landlord/tenant, and title-related issues.

Marty is admitted to practice in Michigan as well as in the federal courts for the Eastern and Western Districts of Michigan, and the United States Court of Appeals for the Third and Sixth Circuits. He also has been admitted pro hac vice in many courts around the country.

Marty possesses a unique combination of expertise and skills, thanks to his participation in high-level mortgage regulatory compliance matters and in hundreds of loan level mortgage litigation disputes. This unparalleled perspective allows him to serve his financial services clients efficiently, cost effectively, and with minimized risk while navigating the spectrum of mortgage origination and servicing processes.

As one of a small, select group of law firms in the United States, Maddin Hauser—led by Marty—participated in the largest default servicing audit in U.S. history as directed by the U. S. Office of the Comptroller of the Currency and Federal Reserve Board.

Among the many articles Marty has had published, two especially stand out: “Navigating the Waters of Real Estate Arbitration” (Commercial, Inc. magazine) and “Seven Common Mistakes in Selecting/Managing Outside Counsel in the Mortgage Industry” (published as a three-part series in the Mortgage Bankers Association News Link).

Marty has spoken nationally on mortgage industry issues, including methods for controlling institutional spending on outside legal counsel. He also has assisted the firm in developing its Lending Litigation ToolKit (L2TK™) designed to reduce institutional costs in the handling of portfolio level litigation. In addition, Marty created the firm’s ASPECT™ System which assists in the efficient testing of client compliance with federal mortgage regulatory requirements.

Marty was featured in the February 2014 issue of Michigan Banker Magazine as well as in an article published in Crain’s Detroit Business focusing on mortgage litigation trends. Michigan Lawyers Weekly recognized Marty as a legal leader and named him a “Go To” Lawyer in Construction Law in 2023 and selected him in its 2022 class of Leaders in the Law, an honor awarded to accomplished individuals who set the standard through a commitment to excellence in the practice of law. Since 2016 he has been recognized as a Michigan Leading Lawyer in Real Estate Law: Commercial and Finance. Marty was selected by his peers as one of Michigan’s rising stars as noted in Michigan Super Lawyers® and Rising Star Magazine.
